Unconditional Apology Will Drop Down Petition: SC

SC on February 16, 2018 issued an order according to which if petitioner telecast an unconditional apology then the case of defamation shall dropped against him. The order came in a petition filed by NDTV journalist Mr. Rahul Kanwal.

Mr. Kanwal during one of his telecast showed involvement of Brigadier PK Tikoo in an attempt of extorting money from a businessman. On this incident Mr. Kanwal was summoned by Judicial Magistrate-I Jammu-Special Mobile Passenger Tax on September 23, 2010 in defamation case.  NDTV journalist thereafter challenged this before J&K high court where his petition was dismissed and he was sent back for trial. Afterwards, Mr. Rahul Kanwal seeks to Supreme Court.

The bench comprising of Justice Arun Mishra and Justice Amitava Roy said

“It is happily agreed by the counsel for the parties that an unconditional apology will be broadcast on 19.02.208 between 10:00 P.M to 10:30 P.M. In case the broadcast is made, the complaint 561 A CrPC shall stand dropped, viz-a-viz to Mr. Rahul Kanwal.”
