Quashing CBSE Selective Revaluation Policy: Punjab & Haryana High Court
The Punjab & Haryana High Court in the case of Shaurya Gulati v. CBSE ordered the Central Board of Secondary Education to accept the revaluation application of a student for revaluating his Physical Education paper. Justice Amit Rawal observed that- “CBSE cannot on its own put fetter restricted qua one paper, permitting in others, since bye-laws do not envisage any restriction of revaluation.”
The court with the reference to Delhi High Court judgement in case of Samrath Mittal v. Union of India where an identical situation arrived in front of Delhi High Court and the CBSE has directed to revaluate the paper of Physical Education as per the Bye-Laws. The court also stated that “there is no rationale behind prohibiting the revaluation of the theory paper of Physical Education.”
Thus, quashing the notice of CBSE under challenge the court ordered CBSE to revalute the theory paper and publishes the results within 2 weeks.
