Constitution Bench to check constitutionality of the TN Amendments to Prevention of Cruelty to Animals Act, 1960

Supreme Court vide order dated February 2, 2018, referred the matter of constitutionality of the TN Amendments to Prevention of Cruelty to Animals Act, 1960 to the Constitutional bench comprises of 5-judges. The bench comprises of CJI Dipak Mishra and Justice RF Nariman in the instant petition found that the petition involves substantial question and therefore to be referred to Constitutional bench. This order of Supreme Court came in the petition of Animal Welfare Board of India v. Union of India. The petitioner in present petition seeks compliance of order passed by the Supreme court in A. Nagaraja case. The bench of KSP Radhakrishnan and PC Ghose, JJ in case of A. Nagaraja said that:

Tamil Nadu Regulation of Jallikattu Act, 2009 was repugnant to the Prevention of Cruelty to Animals Act, 1960 (PCA Act) and had hence, issued a number of directions to ensure the compliance of the PCA Act.
