BCI Can’t Act as Appellate Authority: SC
Supreme Court on February 21, 2018 passed a judgment stating that BCI can’t act like an appellate authority over its own order while exercising review powers. The bench of Justice AK Sikri and Justice Ashok Bhushan delivered this judgment in a petition initiated by Advanta India Ltd against the decision of BCI. In this instant petition the grievance was that the Mr. BN Shivanna respondent in instant petiton was a practicing advocate and he was alleged with serious misconduct. Thereafter, Mr. Shivanna was debarred by State Bar Council and his name was also removed from the rolls of bar council. The BCI in a subsequent decision overturn its previous decision and reduces the punishment of Mr. Shivanna to debarring him for a period of 18 months with fine of Rs. 25,000/-.
The Petitioner challenged the maintainability of review petition before the court.
