Supreme Court: Privacy is a fundamental right

Supreme Court of India has held that right to privacy is a Fundamental Right and it is protected under Article 21 of the Constitution of India. In a unanimous decision the Nine -Judge Constitution bench overruled the Judgments in MP Sharma and Kharak Singh cases. It is held that right to privacy is is protected as intrinsic part of right to life and liberty. It is a landmark case settling the law regarding privacy rights. The Government of India is already in the process of drafting privacy and data protection laws. In our opinion, the right to privacy is very relevant in the present digital world and need to be regulated strictly.
