Plea for complete water cut to Maharashtra Liquor Firms: Dissmissal by Supreme Court

On 24 May, 2016 SC, while exercising its powers refused the plea for directing Government of Maharashtra to cut the water supply to distilleries and breweries.

Plea was approached by petitioner Sanjay Bhaskarrao Kale for complete ban on water supply because the entire region is drought prone, in the apex court where a vacation bench was headed by Justice PC Pant and DY Chandrachud who stated that “these matters are based on policy decisions and interference by judiciary would only amount to taking over governance.”  The SC clearly stated that any decision by the Court in this matter will lead to exercising its powers ultra vires and a direct interference in the work of executive.

The SC also held that when the Bombay High Court is hearing in the matter and already provided 60%, then why the petitioner is coming against the interim order of the court. They pulled down the petitioner by rejecting his plea and said that it is “just for the sake of publicity”.

The Bombay High Court provided the interim order by maintaining the balance between the needs of the individuals and also the requirements for running the industries. The SC asked the counsel of petitioner to dismiss the plea and allowed the petitioner to approach the High Court.
